MENSAGEM DE ANO NOVO - 2013 DE S.E. O PRESIDENTE DA REPÚBLICA TAUR MATAN RUAK

Povo Amado de Timor-Leste.

Preparamo-nos todos para um novo ano de trabalho, depois de, em 2012, termos realizado objetivos importantes para o país.

No ano em que comemorámos o 10º Aniversário da Restauração da Independência, realizámos com êxito três atos eleitorais, que tiveram alta participação dos cidadãos; um novo Presidente da República tomou posse; o Parlamento Nacional iniciou a III Legislatura; e dei posse ao V Governo Constitucional.

Estes êxitos foram acompanhados de um ambiente de paz e estabilidade. A missão das Nações Unidas em Timor-Leste terminou. O nosso país saiu da tutela do Conselho de Segurança. Estes êxitos são razão para satisfação.

Mas, ao começar o ano de 2013, os grandes desafios permanecem: combater a pobreza, aproveitar integralmente os recursos naturais do país, desenvolver uma economia sustentável, alcançarmos uma vida melhor.

Apesar de convicções e opiniões diferentes, que são naturais e positivas, todos concordamos que é necessário trabalhar para ter mais bem estar e construir uma vida melhor.

Como fazer para que isto aconteça? Esta é a questão que trago à nossa atenção. Todos temos de contribuir para lhe dar resposta.

Em primeiro lugar, temos o desafio da comunicação entre governantes e governados. Temos de aperfeiçoar esta comunicação.

O objetivo da comunicação entre governantes e governados é aperfeiçoar o desempenho do Estado e da sociedade, para melhorar a situação do país. Temos de saber ouvir-nos uns aos outros; de dar atenção à opinião dos outros.

Em segundo lugar, temos de integrar a sociedade civil, os cidadãos todos, na construção nacional. Precisamos de um novo modelo de participação.

Somos independentes há dez anos e a participação de todos os cidadãos é necessária para alçançar os objetivos da Nação. A nossa sociedade gosta de reclamar direitos. Mas para construir um país melhor, com mais bem estar, os cidadãos têm, principalmente, de dar atenção aos deveres e responsabilidades. A mentalidade que vê o governo como responsável por tudo e os cidadãos como observadores não ajuda ao desenvolvimento. Precisamos de um novo modelo de participação, com mobilização dos cidadãos e a sua responsabilização na construção nacional.

Em terceiro lugar, temos de combater o improviso e o empirismo.

Devemos utilizar as nossas capacidades intelectuais e técnicas, com rigor e eficácia, para planear e ter capacidade de implementar o que planeámos. Não faltam aos filhos de Timor capacidades técnicas e intelectuais: o que falta é maior rigor e organização. O improviso e o empirismo não chegam para vencer os desafios do desenvolvimento.

Por último, temos de fomentar o trabalho em equipa, o espírito de equipa, no seio da sociedade.

Trabalhar em equipa une a sociedade. Com espírito de equipa, seremos capazes de fazer mais do que trabalhando sozinhos. Só o trabalho em equipa pode alcançar os resultados que desejamos e conseguir uma mudança social com mais bem estar, em todo o país.

O nosso país precisa de aumentar os serviços públicos nos distritos, para fazer o Estado chegar onde está a maioria da população.

O país precisa de criar vários pólos de desenvolvimento, para dinamizar a economia das regiões e criar empregos.

Temos de mobilizar os agricultores e investir para aumentar a produtividade da terra e a comercialização dos seus produtos e reduzir a dependência alimentar.

O país precisa de infraestruturas melhores para criar condições para atrair o investimento privado, diversificar a economia e reduzir a dependência do petróleo.

Este trabalho só terá êxito se soubermos ouvir os interessados, em todo o país, se mobilizarmos a sociedade e trabalharmos com rigor; se cumprirmos os planos e envolvermos os cidadãos, num trabalho de equipa.

Povo amado de Timor-Leste

O país continua a pedir a todos nós dedicação, determinação e trabalho árduo. Podem contar com o Presidente da República para trabalhar com a sociedade civil, com o governo e os restantes órgãos de soberania, para juntos vencermos desafios e conquistarmos novas vitórias para Timor-Leste.

Trabalharei com todos para ajudar a tornar 2013 num ano de impulso ao desenvolvimento e à melhoria das condições de vida. Mas a construção de um futuro de bem-estar está nas vossas mãos.

Vamos trabalhar em equipa e tornar Timor-Leste um país mais forte, e mais rico.

Para todos os Timorenses, dentro do país e residentes no exterior, envio o meu abraço e votos de bom Ano Novo, pacífico, feliz e mais próspero.

2013 NEW YEAR’S MESSAGE FROM H.E. THE PRESIDENT OF THE REPUBLIC TAUR MATAN RUAK

Beloved people of Timor-Leste,

Let us all prepare for a new year of work, following on from 2012, where we achieved important goals for the country.

In the year in which we commemorated the 10th Anniversary of the Restoration of Independence, held three successful electoral processes, which had high citizen participation, a new President took office, the National Parliament began the 3rd Legislature and swore in the 5th Constitutional Government.

These successes were accompanied with an environment of peace and stability. The United Nations mission in Timor-Leste ended. Our country moved away from the tutelage of the Security Council. These successes are reason for contentment.

However, at the start of 2013, the imposing challenges remain: to combat poverty, take full advantage of the country's natural resources, develop a sustainable economy, and achieve a better quality of life.

Despite different opinions and beliefs, which are natural and positive, we all agree that we must work to have a greater wellbeing and build a better life.

What must we do for this to happen? This is the question I bring to our attention. We all have to contribute for there to be an answer.

Firstly, we have the challenge of communication between those who govern and those who are governed. We have to improve this communication.

The goal of communication between those who govern and those who are governed is to enhance the performance of the State and of society, to improve the country's circumstances. We must learn to listen to each other, to pay attention to the opinions of others.

Secondly, we have to integrate civil society and all citizens in nation building. We need a new model of participation.

We are already ten years independent and the participation of all citizens is required to achieve the goals of the Nation. Our society likes to claim rights. But to build a better country, with better quality of life, citizens, essentially, have to pay attention to duties and responsibilities. The mindset that sees the government as responsible for everything and the citizens as observers does not aid development. We need a new model of participation, with citizen mobilisation and its accountability in nation building.

Thirdly, we must combat improvisation and empiricism.

We must use our intellectual abilities and techniques, accurately and effectively, to plan and have the capacity to be able to implement what we have planned. There is no shortage of Timorese offspring’s with technical and intellectual capacities: what is lacking is greater rigor and organisation. Improvisation and empiricism are not enough to meet the challenges of development.

Finally, we need to foster within the bosom of society; team work and team spirit.
 

Team work unites society. With team spirit, we shall be able to do more rather than working alone. Only with team work can we achieve the desired results and achieve social change with greater wellbeing throughout the country.

Our country needs to increase public services in the districts, so that the entire State reaches where the majority of the population is.

The country needs to create several poles of development, to energise the economy of the regions and create employment.

We have to mobilise farmers and invest to increase productivity of the land and the marketing of their products and reduce dependency on food importation.

The country needs better infrastructure to create conditions to attract private investment, diversify the economy and reduce dependence on the oil economy.

This work will only succeed if we listen to stakeholders across the country, if we mobilise society and work arduously; if we fulfill the plans and engage citizens in a team effort.

Beloved people of Timor-Leste,

The country continues to ask of us all of our dedication, determination and hard work. You can count on the President to work with civil society, with the government and other sovereign organs, to mutually overcome the challenges and conquer new victories for Timor-Leste.

I will work with everyone to help make 2013 a momentous year for development and improvement of living conditions. However, the building of a wellbeing future is in your hands.

Let's work together in a team and make Timor-Leste a country stronger and richer.

To all Timorese, within the country and residing abroad, I send you my embrace and my well wishes for the New Year, peaceful, happy and prosperous.

MS destrói medicamentos fora de prazo - PM Xanana reconheceu que se queimou mais de um milhão de dólares

O governo de Timor-Leste procedeu à destruição de medicamentos comprados com o Orçamento Geral do Estado, no valor de mais de um milhão de dólares. 

O primeiro-ministro (PM) apelou ao ministério da Saúde e aos SAMES para fazerem uma boa gestão, para que deste modo no próximo ano, não se estraguem mais medicamentos. 

O chefe do governo fez estas declarações durante a queima dos medicamentos que custaram ao Orçamento do Estado, mais de um milhão de dólares. O PM, Kay Rala Xanana Gusmão, pediu ao ministério da Saúde e aos SAMES para fazerem uma boa gestão, para que no futuro, os medicamentos adquiridos com o Orçamento do Estado não sejam desperdiçados.

"Estes medicamentos são uma grande lição para nós, a partir de 2013 para a frente, eu sei que, o próprio ministro, os dois vice-ministros e vocês, que nós todos vamos falar uns com os outros, olharmos uns pelos outros, apoiarmo-nos mutuamente  para que possamos melhorar e resolver os seguintes grandes problemas que estamos sempre a ouvir: a compra de medicamentos, que não há medicamentos, que os medicamentos não são suficientes, mas, chega-se ao fim do ano, e nós queimamos mais de um milhão (de dólares em medicamentos) ", disse Xanana Gusmão. 

Kay Rala Xanana Gusmão insistiu mais uma vez no seu apelo ao ministério da Saúde e aos SAMES, para estas instituições controlarem o serviço dos medicamentos, para que os remédios comprados com o Orçamento do Estado não sejam desperdiçados no futuro.

Dili. The UN winds up its peacekeeping mission on Monday after 13 years in Asia’s youngest nation East Timor, with the country hoping to overcome its bloody past and rampant poverty to stand on its own feet. 

East Timor this year conducted largely peaceful elections, voting in a new president and parliament, as the country marked a decade of formal independence and paved the way for the foreign forces to leave. 

But as the last remaining UN police and troops trickle home, the fragile democracy is still struggling with widespread malnutrition, high unemployment and maternal mortality rates that are among the worst in the world. 

East Timor was occupied by Indonesia for 24 years, with some 183,000 people dying from fighting, disease and starvation before the half-island state voted for independence in 1999 in a bloody referendum, prompting the first UN mission. 

There is little concern about renewed violence in the immediate future, yet few employment opportunities, crushing poverty and a rapidly expanding population could still threaten peace in the long term, analysts say. 

 “There’s always in this situation the potential for something serious to go wrong,” George Quinn from the Australian National University told AFP. More than 40 percent of young Timorese are jobless, according to AusAID, and although the predominantly Catholic nation has a small population, the fertility rate of 6.5 per woman is the world’s fourth-highest, UN data shows. 

Despite $1.5 billion of aid pouring into the nation of 1.1 million people over the last decade and abundant offshore oil and gas reserves, some 41 percent of the population live on less than the local poverty line of 88 cents a day. 

In and around the capital Dili, barefoot children can be seen eating scraps from the ground in slums, and the pace of life remains slow, with vendors making a pittance at fruit and vegetable markets. World Bank data from 2010 showed 45.3 percent of children under five were malnourished, up from 40.6 percent in 2002, while on the UN’s human development index, East Timor ranks 147th out of 187 nations, below Pakistan and Bangladesh, and well below the regional average. 

East Timor’s economy has also become visibly two-tier since 1999 — there are those raking in US dollars from government infrastructure projects in urban areas, while the majority are subsistence farmers in far-flung villages. 

Prime Minister Xanana Gusmao insisted after his July re-election that energy revenue would transform East Timor “from being an undeveloped, low-income country by 2030, by making use of all our material and human potential.

”While the country’s Petroleum Fund has swollen to $10.5 billion and makes up between 80 to 90 percent of government revenue, critics point out the reserves are fast falling as they call for diversification of the economy. Rural Timorese also complain the money has not changed their lives, saying the funds are channelled to the city through infrastructure projects. “East Timor has always had a problem with properly disbursing its income, and that problem still persists,” Quinn said. 

Despite the problems still facing East Timor, the departure of the remaining UN forces — which numbered 1,600 at the mission’s peak — nevertheless underscores the progress the country has made in recent years. 

The withdrawal has been welcomed by most, especially leaders who insisted on the country’s ability to handle its own security well before responsibility was handed back to national police in October.

A ex ministra da Justiça, Lúcia Lobato, já deixou a cela da polícia distrital de Díli, onde se encontrava detida desde ontem, anunciou a TVTL na sua página do Facebook.

De acordo com a mesma fonte, "... a Policia Nacional de Timor-Leste autorizou Lobato a voltar para casa, após o Tribunal Distrital de Díli lhe ter aplicado o Termo de Identidade e Residência".

O advogado da ex titular da pasta da Justiça, Pedro Aparício, em declarações ontem à TVTL disse que, foi interposto um recurso extraordinário e que este deu entrada e foi registado às quatro da tarde de ontem. O causídico acusou ainda os tribunais timorenses de estarem a fazer " perseguição política à sua cliente" porque a detenção de Lúcia Lobato foi ilegal e inconstitucional.

"Esta decisão feita pelo tribunal é inconstitucional e ilegal porque este processo já foi iniciado e a decisão proferida pelo Tribunal de Recurso não vale, é contrária à Constituição, não tem valor, porque ainda há imunidade, se isto acontecer, nós podemos dizer que os tribunais em Timor fazem perseguição política", declarou Pedro Aparício à TVTL.

Lúcia Lobato foi sentenciada pelo Tribunal Distrital de Díli a uma pena de prisão de cinco anos por crimes de corrupção, a ex ministra da Justiça recorreu desta sentença, todavia, o Tribunal de Recurso confirmou a sentença da judicatura de primeira instância.

A suspeita da prática da corrupção dentro do atual governo paira ainda sobre os ombros de alguns ministros chave do executivo de Gusmão, nomeadamente no do ministro da Agricultura, Mariano Assanami Sabino, e recentemente sobre o da responsável da pasta das Finanças, Emília Pires.

Ainda não foi tornado público se ambos os ministros acima mencionados estão ou não a ser investigados pela Comissão Anticorrupção, pelos alegados atos de corrupção de que são acusados.

PNTL capturou a antiga MJ - "Advogado de Lúcia Lobato considera que os tribunais de Timor fazem perseguição política"

A Polícia Nacional de Timor-Leste (PNTL) deteve em Bidau a ex ministra da Justiça, Lúcia Lobato, após o Tribunal de Díli ter emitido um mandato de captura. O advogado da arguida Lúcia Lobato considera que o mandato de apreensão está cheio de tendências políticas. 

O Tribunal Distrital de Díli expediu um mandato de captura à ex ministra da Justiça, Lúcia Lobato, no passado sábado, mas o mandato de detenção foi executado ontem pela PNTL, para se procederem aos primeiros interrogatórios. 

A arguida Lúcia Lobato chegou ao Tribunal Distrital de Díli cerca das quatro horas da tarde para fazer o registo, antes do primeiro interrogatório que será efetuado hoje. 

"A detenção foi emitida no dia 22 e eles efetuaram e aplicaram a captura à arguida alegando que, o tribunal vai julgar. Eu quero dizer a todos que, durante todo este tempo e logo desde o início que a minha cliente colaborou com o processo e com a justiça, não existem razões para a deterem, contudo, como o juiz é quem tem a autoridade para decretar a detenção e ele tem o direito de fazer isto. Todavia, nós queremos dizer que, não é necessário emitir um mandato de captura, porque não existe um perigo de fuga por parte da arguida, não há indicação de que Lúcia Lobato vai fugir para o estrangeiro, " declarou o advogado Sérgio. 

O advogado de Lúcia Lobato considerou que o mandato de captura está cheio de tendências políticas. 

"O recurso extraordinário deu entrada às quatro horas e foi registado no Tribunal de Díli e os polícias executaram a ordem de detenção para um problema que é o mesmo. Nós fizemos o recurso da sentença que o tribunal proferiu, isto é inconstitucional e existem irregularidades por causa disto. O tribunal dentro do prazo ainda vai mandar para o Ministério Público estudar e este depois irá fazer o contra recurso do que nós demos, normalmente, de acordo com estas regras, primeiro efetua-se o primeiro interrogatório do processo no tribunal de Díli e depois "sobe" para o Tribunal de Recurso e depois é que se toma uma decisão, esta é depois proferida, não existem decisões superiores às que são decididas pelo Tribunal de Recurso. Esta decisão feita pelo tribunal é inconstitucional e ilegal porque este processo já foi iniciado e a decisão proferida pelo Tribunal de Recurso não vale, é contrária à Constituição, não tem valor, porque ainda há imunidade, se isto acontecer, nós podemos dizer que os tribunais em Timor fazem perseguição política", disse Pedro Aparício. 

Neste momento a arguida Lúcia Lobato, encontra-se detida numa cela da polícia do distrito de Díli à espera do primeiro interrogatório que será feito hoje. Anteriormente, o Tribunal de Recurso reforçou a sentença aplicada à ex ministra Lobato, pelo tribunal de primeira instância aplicando-lhe uma pena de cinco anos de prisão.

EMILIA: "NO COMMENT" REGARDING HER SUSPECTED BREAKING OF THE LAW

Journalists have been denied any comment or response from the Finance Minister despite their repeated requests for interviews with her or for information from her to try to clarify allegations that have recently arisen regarding her in the press, and this from a Minister who has in the past repeatedly declared herself to the public as the motor for transparency and accountability. 

The question must be asked; what is Minister Emilia hiding from the public? 

On 27 November 2012, shortly before the commemoration of the 37th anniversary of Timor-Leste's independence, Tempo Semanal published allegations of Corruption, Collusion and Nepotism (commonly known by its Indonesian acronym "KKN") against the Finance Minister, Emilia Pires. 

The allegations against this senior member of the government, who has held the Finance portfolio for the second term of government, emerges from circumstances where budget funds were approved to enable acquisition of goods from a company owned by her husband. 

 This conduct by the Finance Minister, Emilia Pires is suspected of breaching the conflict of interest provisions for state agents established in article 32, chapter IV on Incompatibility, of Law No. 10/2005, The Legal Regime on Procurement. 

The Minister who is fond of claiming utmost transparency and accountability feigned at not knowing of and letting through to acquire a government contract her husband's company. 

To try and find answers to these questions raised about the conduct of the Finance Minister Emilia Pires, from prior to the date of publication, Tempo Semanal has tried on multiple occasions through various means to seek confirmation of certain facts from her. However, we have been unable to get any response whatsoever from her despite our repeated efforts. 

On Tuesday, 11 December 2012, Tempo Semanal tried once again to get a response to questions from the Finance Minister personally during her attendance at the National Parliament. However, the Finance Minister herself declined making any comments to us. "I will not comment to the whoever in the press regarding this issue," the Finance Minister told Tempo Semanal. 

The raising of these allegations have stirred great public controversy, because of statements made by the Director of the Guido Valadares National Hospital, Odete da Silva Viegas to Tempo Semanal on 23 November 2012, that according to her letter of request with reference number 130/adm/HNGV/III/2012, which she addressed to the Vice Minister for Health, Madalena Hanjan, there was no request for the equipment ultimately supplied by the company Mac's Metalcraft Pty Ltd, a company owned by and whose director is Warren Mc Leod, the husband of the Finance Minister, Emilia Pires. Worse, some state agents used the request from the Director of the Guido Valadares National Hospital as justification to seek additional unallocated budget funds, which had already been pre-arranged in February 2012. 

Looking at the details born out in the documents in this case, there are things that were clearly not right. The request from the director of the National Hospital to the former Vice Minister for Health, Madalena F.N.H Costa Soares Bsn, on 22 March 2012 request the urgent purchase of medical equipment related to the work of the Hemodialysis Unit. This included equipment like two Hemodialysis machines, two sets of beds and consumables to enable the unit to undertake its work in caring for patients requiring hemodialysis treatment. 

According to the list annexed to the letter signed by the National Director of NALA, Leao Borges, S Sos. MPH, Head of the Medical Equipment Management Department, Avelino Afonso Brites and former Vice Minister of Health, Madalena F.N.H. Costa Soares Bsn, a budget of US$2,004,100.00 was proposed to purchase 17 items for the hospital and health centres. But what is interesting from the items listed in the annexure to the letter sent by the Vice Minister for Health, Madalena Hanjan to the Finance Minister, Emilia Pires, the first five items listed were all equipment to be purchased from the company Mac's Metalcraft Pty. Ltd. 

So if we look at the whole process from beginning to end, we conclude that there was "collusion" at high level between some members of government during which they tested one another on ways in which their family members could financially benefit from the budget of the state. 

Because, prior to the Director of the National Hospital sent off her letter on 22 March 2012, the Finance Minister, Emilia Pires had already approved the budget request that had been proposed by the Vice Minister for Health, Madalena Hanjan. Immediately after the Finance Minister approved the request for additional budget funds from the government's contingency fund, on 24 February 2012, Warren Mc Leod, the Director of the company Mac's Metalcraft submitted his quotation to Agapito da Costa, the Procurement Officer for the Ministry of Health. 

Following this on 21 March 2012 the Vice Minister for Health wrote to Prime Minister Xanana and copied the Finance Minister. Madalena Hanjan proposed in that letter for the company Mac's Metalcraft to be the sole supplier because it was an emergency purchase. 

Interestingly, in February the Vice Minister for Health used only the letter of request from the Director of the National Hospital for two hemodialysis machines and two beds as the basis for her justification to back up her request for funds as being an emergency. 

However, equipment ultimately supplied by Mac's Metalcraft including some of the eighty (80) beds are in storage at the National Hospital. 

 "The Finance Minister is a 'public official'. Because of this very reason she cannot approve funds to her family's company, but least of all her husband's. With this the Finance Minister has breached the Procurement Law," said the director of Luta Hamutuk, Mericio Akara to Tempo Semanal. According to Akara, 30% of procurement projects are awarded through single sourcing currently."

But, the mechanism was also frequently breached. Such as single sourcing, which is justified when there is an emergency or something needs to be acquired quickly. But, if there is no emergency though I do not think it can be single sourced. If there is a natural disaster we can understand if the procurement is treated as an emergency. 

But, too many times procurement that is not really an emergency are categorized as emergencies and treated accordingly. Because of this, indications of KKN (Corruption Collusion and Nepotism) arise in these emergency procurements. 

Despite this, this is the course used to access funds to spend quickly. Because, with this approach, they can use single sourcing. But this way they can also engage in all forms of manipulation, because if it has to undergo normal procurement processes then there is no course available for them to engage in KKN. 

So, this is why they use single sourcing. It is not only though single sourcing though, because via normal procurement processes they also try to manipulate things, then it is easier to do with single sourcing where there are no means of control. In these type of processes, whoever has the power makes the decisions. So, if they have family relations involved they do not need to be afraid of giving it to them. People are already used to it, use to saying that someone inside gave a contract to their relative," Akara accused. 

 Previously, in its edition number 42, Tempo Semanal published an interview with the Jose Neves, one of the deputy commissioner of the Anti Corruption Commission (Tetum acronym: "KAK"), wherein he said that the equipment acquired in the case in question could not be classed as emergency items. He added that they had simply invented this as being an emergency acquisition. 

Akara explained that, KAK has to be proactive in investigating these cases. Because, it is an extraordinary institution created to be proactive in investigating such cases, not just wait to act on complaints. KAK has to be proactive and we recommend that that it should not fear anyone in Timor-Leste. KAK as an extraordinary institution should not be wary of anyone and if there are clear indications of KKN then it should investigate it immediately.
